Document drawn up in accordance with Law No. 284/2004 on Information Society Services, Law No. 195/2024 on Personal Data Protection, Law No. 105/2003 on Consumer Protection and good e-commerce practices.

1. Preamble and Acceptance of the Terms

This document (hereinafter the “Terms of Reference”) sets out the general conditions for the use of the website www.moonglow.md and for the provision of the information society services offered through it, within the meaning of Law No. 284/2004 on Information Society Services.

Accessing and using the website, creating a user account or placing an order constitutes express and unconditional acceptance of these Terms of Reference, of the commercial Terms and Conditions published separately on the website, and of the Privacy Policy. If you do not agree with any of these documents, please do not use the website.

2. Information about the Service Provider

In accordance with the transparency requirements of Article 12 of Law No. 284/2004, the service provider makes the following information available to the recipients of the services and to the supervisory authorities:

3. Definitions

For the purposes of this document, the following terms shall have the meanings set out below, taken and adapted from Law No. 284/2004 on Information Society Services:

3.1 Information society service means any service provided at a distance, by electronic means and at the individual request of the recipient, including the online sale of goods, such as the services offered through the website www.moonglow.md.
3.2 Service provider means Resource Alliance SRL, the legal entity that makes information society services available to recipients through the website www.moonglow.md.
3.3 Recipient of the services means any natural or legal person who uses the website and the services offered through it.
3.4 Consumer means any natural person acting for purposes outside his or her trade, business or profession.
3.5 Commercial communication means any form of communication designed to promote, directly or indirectly, the goods, services or image of Resource Alliance SRL, including Newsletter messages and promotional communications.
3.6 Electronic contract means the contract concluded between the service provider and the recipient of the services by electronic means, by placing an order on the website.

4. Scope and Conditions of Access

These Terms of Reference apply to all persons who access or use the website www.moonglow.md, whether or not they create a user account.

The services offered on the website are intended for persons aged at least 14. Persons under the age of 14 may create an account or place an order only with the prior consent of their legal representative, in accordance with the personal data protection provisions applicable to minors.

The service provider reserves the right to suspend or restrict access to the website for any user who breaches these Terms of Reference, the commercial Terms and Conditions or the applicable legislation.

5. Description of the Services Offered

Through the website www.moonglow.md, Resource Alliance SRL offers the following information society services:

5.1 Online sale of cosmetic and perfumery products, with delivery within the territory of the Republic of Moldova and, where applicable, outside it, under the conditions detailed in the commercial Terms and Conditions published on the website.
5.2 Creation and management of a user account, including management of personal data, order history and loyalty programs.
5.3 The Beautycoin loyalty program and the referral link mechanism, described in detail in the commercial Terms and Conditions.
5.4 The possibility to publish reviews of purchased products, subject to prior approval by the website administrator.
5.5 Sending of commercial communications (Newsletter, promotional offers), subject to the recipient’s prior consent, in accordance with Section 8 below.

The detailed commercial conditions (prices, payment methods, delivery times and costs, return policy, gift certificates, discounts and promotions) are set out in the Terms and Conditions document, published separately on the website, which forms an integral part of the contractual relationship between the service provider and the recipient of the services.

6. Conclusion of the Distance Contract and Placement of the Electronic Order

In accordance with Articles 21 and 23 of Law No. 284/2004, before placing an order, the recipient of the services is informed, in clear and accessible language, of:

6.1 The technical steps to be followed to conclude the contract: selecting the products, adding them to the shopping cart, filling in the delivery and billing details, choosing the payment method and final confirmation of the order.
6.2 The fact that, once concluded, the contract (order confirmation, product specifications and price) is stored by the service provider and may subsequently be accessed by the recipient in his or her personal account or, upon request, by email.
6.3 The technical means made available to the recipient for identifying and correcting data entry errors before placing the order, including the possibility to review and modify the contents of the shopping cart before final confirmation.
6.4 The language in which the contract may be concluded: Romanian. On its own initiative, the service provider may also provide information in other languages.

After the order is placed, the service provider shall acknowledge receipt of the order by electronic means without undue delay, including its acceptance or rejection, in accordance with Article 23(1) of Law No. 284/2004. The order and the related acknowledgement are deemed to be received when the parties to whom they are addressed are able to access them.

The distance contract is deemed concluded at the moment the order is confirmed by the service provider, in the manner described in the commercial Terms and Conditions.

7. Prices, Payment, Delivery and Returns

Product prices are displayed on the website in Moldovan lei (MDL) and include, where applicable, value added tax, in accordance with the tax legislation in force. Delivery costs are communicated separately before the order is finalized.

The accepted payment methods, delivery times and costs, as well as the conditions for returning products, are set out in detail in the Terms and Conditions document published on the website, to which the provisions of Law No. 105/2003 on Consumer Protection additionally apply.

8. Commercial Communications and Direct Marketing

In accordance with Article 22 of Law No. 284/2004, commercial communications are sent to the recipient of the services by email or by text message (SMS) only on the basis of the recipient’s prior express consent.

Any commercial communication sent by Resource Alliance SRL is clearly identifiable as such and clearly indicates the identity of the sender, and promotional offers, discounts, contests and loyalty campaigns are presented together with the conditions of participation, in a clear and accessible manner.

The recipient has the right to refuse, at any time and free of charge, to receive commercial communications, by unsubscribing from his or her personal account, by clicking the unsubscribe link included in each message or by contacting the service provider at the email address indicated in Section 2.

9. Personal Data Protection

The personal data of the recipients of the services are processed by Resource Alliance SRL in accordance with Law No. 195/2024 on Personal Data Protection and Article 10 of Law No. 284/2004 on Information Society Services.

The categories of data collected, the purposes and legal bases of the processing, the storage period, the recipients of the data, any international transfers, as well as the rights of data subjects (access, rectification, erasure, restriction, portability, objection) are detailed in the Privacy Policy, published on the website, which forms an integral part of these Terms of Reference.

Resource Alliance SRL implements appropriate technical and organizational measures to protect personal data against unauthorized access, loss, destruction or unlawful disclosure, in accordance with Article 10(1) of Law No. 284/2004.

Any request concerning the exercise of rights relating to personal data shall be sent to the contact address indicated in the Privacy Policy. The data subject has the right to lodge a complaint with the National Center for Personal Data Protection.

10. Intellectual Property and User-Generated Content

The content of the website www.moonglow.md, including texts, images, logos, trademarks and the structure of the website, is the property of Resource Alliance SRL or its partners and is protected by intellectual property legislation. Reproduction, distribution or commercial use of this content without the prior written consent of Resource Alliance SRL is prohibited.

By publishing a review or any other content on the website, the recipient of the services grants Resource Alliance SRL the non-exclusive right to use, reproduce and publish such content for purposes related to the activity of the website, while respecting the author’s moral rights. Resource Alliance SRL reserves the right to moderate, edit or remove reviews that violate the legislation in force or the publication rules displayed on the website.

11. Liability of the Service Provider

In accordance with Article 14 of Law No. 284/2004, Resource Alliance SRL is liable for the information provided on its own initiative or on its behalf and displayed on the website www.moonglow.md.

Resource Alliance SRL makes reasonable efforts to ensure the accuracy of the information on products, prices and stock availability, but cannot guarantee the complete absence of technical or editorial errors. In the event of an obvious error in price or description, Resource Alliance SRL reserves the right to cancel or correct the affected order, after informing the customer in advance.

Resource Alliance SRL shall not be liable for temporary interruptions in the operation of the website caused by technical reasons, maintenance or events beyond its control.

12. Complaints, Dispute Resolution and Competent Authorities

Any complaint regarding the use of the website, the performance of orders or the processing of personal data may be addressed to Resource Alliance SRL at the contact address indicated in Section 2.

If the complaint is not resolved amicably, the recipient of the services, acting as a consumer, may refer the matter to the State Inspectorate for Supervision of Non-Food Products and Consumer Protection, in accordance with Law No. 105/2003 on Consumer Protection, or to the competent courts of the Republic of Moldova.

Complaints regarding the processing of personal data may be submitted to the National Center for Personal Data Protection, in accordance with Law No. 195/2024.

13. Amendment of the Terms of Reference and Final Provisions

Resource Alliance SRL reserves the right to amend these Terms of Reference. Minor amendments take effect on the date the updated version is published on the website, with at least 7 days’ prior notice. Substantial amendments affecting the essential rights of the recipients of the services will be communicated with at least 30 days’ prior notice.

These Terms of Reference are governed by the legislation of the Republic of Moldova. Any dispute that cannot be resolved amicably shall be submitted to the competent courts of the Republic of Moldova.

If any provision of these Terms of Reference is declared null or unenforceable, the remaining provisions shall remain valid.

This document is supplemented by the provisions of the commercial Terms and Conditions and the Privacy Policy published on the website www.moonglow.md, which form an integral part of the contractual relationship between Resource Alliance SRL and the recipients of the services.
